A&B Trucking Terms & Conditions

1. Rates apply on prepaid outbound traffic only.
2. Unless otherwise stated, rates shown herein are expressed in Canadian dollars per pound per individual shipment covered by a single waybill from one shipper to one consignee. Weights will be rounded up to the next whole pound or kilogram, depending on the unit of measure utilized (excluding minimum charge).
3. A&B Courier will not be held liable on any costs or penalties arising from late deliveries or missed appointments.
4. General freight $2.00 per pound of shipment.
5. The customer warrants that the contents of the shipment are properly and fully declared, as well as being properly packed and labelled. The customer shall ensure that A&B Courier has all the information and documentation necessary to comply with the laws and regulations of any country involved in the transportation of the shipment. A&B Courier will not be liable for loss or damage incurred as a result of the shipper's failure to meet this condition.
6. C.O.D.'S will be accepted to major Canadian Cities served directly at a charged of 5% of the C.O.D. amount subject to a minimum of $12.50 per shipment. Where it is available to other Canadian destinations, the fee is 6% of the C.O.D. amount, subject to a minimum of $30.00. C.O.D. shipments will be handled on a cash or certified cheque basis only. Payment in any other form must be approved by the shipper in writing. A&B Courier assumes no liability for NSF company or personal cheques collected on the shipper's instructions. Cancelled C.O.D.'s will be subject to a cancellation charge of $12.50 per shipment
7. When the bill of lading indicates that the shipper requires the carrier to accept liabilities up to a stated declared value and excess valuation charge of 1% of the valuation in excess of the limit of liability. Minimum charge of $2.50.
8. Packages and waybills must show the complete delivery address, including postal code. A&B Courier cannot deliver to P.O. Boxes. In the case of a rural route address, the complete name and telephone numbers must also be included with the address. ( A rural route delivery charge may apply) A&B Courier will not be responsible for service delays due to improper or incomplete delivery information.
8.1 Delivery Service Delivery during regular business hours is deemed to be from Monday to Friday excluding statutory Federal or Provincial holidays between the hours of 9:00 a.m. and 5:00 p.m. local time. Delivery service prior to 9:00 a.m. is available at an additional charge. A&B Courier will furnish one driver to perform the pick up or delivery. Regular pick up or delivery service excludes sorting, packing or labeling of the shipments by the driver. Extra help can be arranged for upon request at a rate of $50.00 per hour, per man and subject to a 3 hour minimum. Power tailgate service can be provided upon request at a charge of $75.00 per delivery or pick up. Weekend or after regular business hours service is available. Charges for these services will be determined by A&B Courier on a case by case basis. Heated service is seasonally available for certain lanes and modes of transport. Oversize and overweight items will also be subject to delay due to aircraft loading limitations. Oversize and overweight items will also be subject to additional charges if it is not possible to include any such shipment with other general air cargo in an aircraft container. A&B Courier reserves the right to reweigh shipments, notwithstanding that a weight has been declared on the shipping document. The reweighed determined by A&B Courier may be applied for the assessments of rates, and the shipper agrees to pay same.
8.2 Beyond Deliveries or Pick Ups Shipments to or from points outside of the A&B Courier local cartage area will be assessed a beyond charge from the nearest terminal in addition to the regular transportation charges based on the A&B Courier inland tariff.
8.3 Prohibited by Law No service shall be rendered by A&B Courier in the transportation of any shipment which is prohibited by law or regulations of any federal, state, provincial, or local government in the origin or destination countries.
8.4 Dangerous Goods Dangerous goods, provided that they comply with all provisions of the "IATA Dangerous Goods Regulations Act" and the "Canadian Transportation of Dangerous Goods Act" will be accepted, with the exceptions of explosives, radioactive substances or hazardous wastes, to direct points only. A&B Courier reserves the right to refuse a shipment based on safety, security, or legal limitations. Dangerous goods shipped without prior full disclosure may be warehoused at the customer's risk and expense and A&B Courier shall not accept liability for loss, damage or delay caused by an undisclosed shipment of prohibited items.
8.5 In Bond Shipments Shipments traveling in bond are subject to additional charges for sufferance, clearance, handling and terminal fees when applicable.
8.6 Interruption of Service A&B Courier will not be liable for any interruption of service caused by acts of God, strikes, lockouts, labour disputes, or weather related delays.
8.7 Refusal of Shipments A&B Courier reserves the right to refuse any shipment which by reason is dangerous or any other character of it's contents is liable, in judgment of A&B Courier to soil, taint or otherwise damage other merchandise or equipment, or which is economically or operationally impracticable to transport, or which is improperly packaged, wrapped or labelled.
8.8 Dead Call Charge (Unavailable Pick-ups) If A&B Courier is unable to make pick up of a shipment, the shipper will be informed and a dead call charge will be assessed. Minimum charge of $20.00.
8.9 Limits & Restrictions The on time delivery guarantee does not apply to shipments which are delayed due to causes beyond A&B Courier's control including, but not limited to the following; the unavailability or refusal of a person to accept delivery of the shipment, delays caused by the consignee, acts of God, the Queen's or public enemies, public authorities, acting with actual or apparent authority on the premises, acts or omissions of customs or similar authorities, riots, strikes or other labour disputes, civil commotions, disruptions in the air or ground transportation network, authority of law, defect or inherent vice in the goods shipped, and nuclear reaction, radiation or radio active contamination.
8.10 Delay A&B Courier is not financially responsible for the consequences of failure to deliver a shipment by a stipulated time.
8.11 Taxes Rates and charges are subject tall applicable government taxes. Rates and charges may also be subject to industry surcharges such as, but not limited to, fuel surcharges. Rates are subject to change without notice.
8.12 Method of Transportation & Routing of Shipments A&B Courier undertakes to complete the carriage hereunder with reasonable dispatch. A&B Courier may use alternate carriers, aircraft, methods or modes of transportation without notice and with due regard to the interests of the customer. A&B Courier is authorized by the customer to select the routing and all intermediate stopping places that it deems appropriate or to change or deviate form the routing, if any, as stated on the waybill.
9. Copies of proof of deliveries are available at a cost of $7.50 each. If the P.O.D. is concerning a damaged shipment for claim purposes, it will be provided at no additional charge. Upon request from a customer, P.O.D.'s can be provided as a back up to invoices. This service will be provided at an additional charge of $1.00 per shipment. This fee will be assessed on each waybill at the time of billing.
10. If more than one delivery attempt is required within A&B Courier's local cartage areas, a minimum re-delivery charge of $20.00 will be assessed.

Procedures for Claims
Claims may be submitted to A&B Courier by telephone at (905)853-444 or in writing to:

All Claim notifications must include shipment details, including address information(from/to), date of shipment, package weight, the A&B Courier control number, the waybill number and a detailed statement of what is being claimed.

Claims must be lodged within the following time periods: Loss or Damage Claims Verbal notification within 24 hours Written notification within 15 days
Claims of Concealed Damage Verbal notification within 48 hours of delivery
Service Guarantee Claims Verbal notification within 24 hours Written notification within 15 days

The right to damages against A&B Courier shall be extinguished unless action is brought within two years from the date of delivery of the shipment or from the date of which the shipment should have been delivered. A&B Courier will not act on any claim until all transportation charges have been paid.

12.

Invoicing Options

A&B Courier provides the following invoicing options:

Within Canada-Collect, Prepaid, Third Party Internationally- Prepaid

The following explains the meanings of the invoice options:

Collect The consignee pays all shipping charges, and the destinations country's duty & tax if applicable. This option is not available for International shipments.

Prepaid The shipper pays all shipping charges including additional charges. The consignee pays the destination country's duty and tax if applicable.

Third Party the shipper may request their portion of the shipping charges to be invoiced to an alternative party. This party must have a current A&B Courier account.

12.1

For All Invoicing Options
The shipper must notify the consignee prior to shipping if any option other than prepaid is selected and the invoicing option must be indicated on the appropriate A&B Courier pick up record in the space provided.

The shipper is liable for payment in the event of non-payment by the consignee or the alternative party.

13. By entrusting the shipment to A&B Courier, the customer agrees to all the terms and conditions contained on the waybill and as set out in the terms and conditions. The terms of this agreement shall be binding on both A&B Courier and the customer. No one is authorized to alter, modify or waive any provisions of this agreement.
